Financial Orders when a marriage breakdowns
There are many cases, where often a dispute arises between couples in reaching an agreement relating to financial and property matters. Individuals can request the court to make a ‘financial order’; formerly called an ‘ancillary relief order’.
You can apply for a financial order if you want, for example:
Applying for a financial order currently costs £255
The procedure is separate from the divorce and usually takes longer (often 6 moths to 1 year).
You may be required to attend a court appointment and attend a number of court hearings.
You’ll however, need to prove that you’ve considered mediation when you apply for a financial order – this doesn’t apply in some cases, e.g. if there’s been domestic abuse.
You can do this by filling in the mediation section of the application form.
